At the heart of this legal and creative battle lies the CBFC’s staunch objection to naming the film’s lead character, a rape survivor, “Janaki.” The censor board’s reasoning is rooted in a perceived religious slight, arguing that the name is synonymous with Goddess Sita, a revered figure in Hindu mythology. According to the CBFC, associating such a name with a survivor of sexual assault could be deemed offensive to religious sentiments.

Filmmakers’ Plea: A Common Name, Not a Defamation

Cosmos Entertainments, represented by their counsel, vociferously refuted the CBFC’s stance in their petition to the Kerala High Court. They acknowledge that “Janaki” is indeed an alternative name for Goddess Sita, but critically emphasize its widespread usage as a common given name across various regions of India. The creators asserted their complete lack of intention to disparage Goddess Sita or any deeply held belief system within the nation.

Furthermore, the production company highlighted the practical impossibilities of acceding to the CBFC’s demand at this late stage of the film’s production. Altering the character’s name now would entail significant re-shoots, dialogue changes, and a complete overhaul of the final edits, posing an insurmountable hurdle for the project.

Adding weight to their argument, the petitioners pointed out a striking inconsistency: the very same CBFC had previously granted a certification to another film titled Janaki Jaane. This precedent, they contend, underscores the arbitrary nature of the current objection.

Justice N Nagaresh, the presiding judge who will personally oversee the film’s screening alongside representatives from both the petitioners and the CBFC, articulated the rationale behind this unusual judicial step. As quoted by The Hindu, Justice Nagaresh stated, “Considering the allegations in the petitions, I believe it is appropriate to watch the movie before arriving at a decision.” This direct engagement by the judiciary signals the gravity with which the court views the allegations of censorship and the potential infringement on artistic expression.

Industry Rallies: AMMA Slams CBFC Stand

The CBFC’s decision has not only faced legal challenge but has also drawn widespread condemnation from within the Malayalam film industry. The Association of Malayalam Movie Artists (AMMA), a prominent film body, has voiced strong opposition, defending the filmmakers’ creative choices.

Joy Mathew, a key member of AMMA’s ad hoc committee, minced no words in his criticism. “What a joke!” he exclaimed, expressing disbelief at the censor board’s reasoning. Mathew highlighted the common practice in India, across films, public figures, and even governmental entities, of drawing names from ancient epics and rich cultural traditions. He questioned the specific targeting of “Janaki” when countless films feature characters named Sita, Ram, Mohammad, or George, suggesting the CBFC’s objection might stem more from an “ego” dispute than a legitimate concern.
